AroundEx – Terms and Conditions
Welcome to AroundEx (“the Platform”). AroundEx provides an online marketplace (the “Service”) where:
- • Travelers can offer space in their personal luggage to carry items for Senders on their trips to earn additional income.
- • Senders can request Travelers to deliver items on their behalf to a specified location.
By using AroundEx, you (“User,” “you,” or “your”) agree to the following Terms and Conditions (“Terms”). If you do not agree, do not use the Service.
User Eligibility
- 1. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
- 2. By registering, you represent that you have the legal capacity to enter into these Terms.
- 3. AroundEx reserves the right to suspend or terminate any account if there is a violation of these Terms or any applicable laws.
Scope of Services
- 1. Marketplace Only: AroundEx is a neutral platform that facilitates connections between Senders and Travelers. We are not a shipping company, air courier, customs broker, or freight forwarder.
- 2. No Endorsement: AroundEx does not endorse, guarantee, or take responsibility for Users’ compliance with any local, national, or international laws, including but not limited to customs regulations, prohibited items lists, or airline baggage restrictions.
User Responsibilities
4.1 Sender Responsibilities
- 1. Accurate Item Descriptions: You must accurately describe any item(s) you wish the Traveler to deliver, including weight, dimensions, and contents.
- 2. Legal Compliance: You are solely responsible for ensuring that the items are legal in both the origin and destination countries. This includes complying with all import, export, customs, and tax requirements.
- • All items must be properly packaged to ensure safe transport.
- • Necessary documentation (e.g., customs forms, receipts, permits) must be provided.
- 4. No Dangerous or Prohibited Goods: It is strictly forbidden to send items that are illegal, dangerous, hazardous, flammable, explosive, or otherwise restricted under local and international laws (e.g., drugs, firearms, counterfeit goods).
- 5. Airline/X-Ray Checks: The Sender agrees that the item(s) must be checked through normal airline procedures, including X-Ray or security checks. The Sender is solely responsible for the item passing security.
- 6. No Liability on AroundEx: AroundEx cannot be held responsible for any item seized or destroyed by authorities. Any financial or legal consequences arising from the item’s contents are entirely the Sender’s responsibility.
4.2 Traveler Responsibilities
- 1. Accurate Trip Information: You must provide accurate travel details (departure, arrival, flight number, etc.) and keep the Sender informed of any changes.
- 2. Check Local Laws: Travelers are responsible for ensuring that carrying items on behalf of a Sender is permitted under the laws of the origin, transit, and destination countries.
- 3. Airline Baggage Compliance: You must comply with airline baggage rules, including size, weight, and prohibited items.
- 4. Inspection Rights: You have the right to inspect the items before accepting them for delivery. If the item does not match the agreed description or is suspected to be illegal or dangerous, you must refuse to transport it.
- 5. No Liability on AroundEx: AroundEx is not responsible for any penalties, fines, or legal issues a Traveler may face if found carrying illegal or restricted goods. The Traveler accepts full liability for all items they choose to carry.
5. Payment Terms
- 1. Negotiated Price: Senders and Travelers negotiate the delivery fee or reward. AroundEx may provide suggested rates but does not set or control User pricing directly.
- • Payment methods and timelines are determined by the agreement between Sender and Traveler.
- • AroundEx may offer payment facilitation tools; in such cases, transaction fees may apply.
- 3. Non-Refundable Fees: Platform fees, if any, may be non-refundable unless otherwise stated.
6. Risk Acknowledgment & Disclaimer
- 1. User-to-User Transactions: Transactions facilitated by AroundEx are strictly between the Sender and the Traveler. AroundEx is not a party to these agreements.
- 2. No Guarantee: AroundEx does not guarantee the successful delivery or the condition of the goods transported, nor does it guarantee that the Traveler or Sender will fulfill their obligations.
- 3. Release of Liability:
- • Users agree to release AroundEx from any claims, demands, damages, or disputes arising from or related to the Service.
- • No Responsibility: AroundEx does not take responsibility for any damages, losses, or legal repercussions that arise during transit or upon delivery.
7. Prohibited Activities
- 1. Illegal Use: You may not use AroundEx for any unlawful purpose (including transport of illicit substances, weapons, counterfeit goods, etc.).
- 2. Fraud or Misrepresentation: You must not provide false information or attempt to defraud other Users.
- 3. Violation of Airline, Customs, or Postal Regulations: All local, national, and international regulations must be respected.
- 4. Platform Integrity: Attempting to disrupt or harm the platform (e.g., hacking, spamming, misuse of data) is strictly prohibited.
8. Intellectual Property
- 1. Ownership: All AroundEx logos, branding, and website content are the intellectual property of AroundEx.
- 2. Limited License: Users may not use AroundEx’s intellectual property without explicit written permission, except for referencing or linking to the platform in a fair manner.
9. Indemnification
Users agree to indemnify and hold harmless AroundEx, its affiliates, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of:
- 1. User Content or items provided by the Sender.
- 2. User Actions in transporting goods or using the platform.
- 3. Violations of these Terms or any applicable laws.
10. Limitation of Liability
- 1. No Liability for Damages: To the fullest extent permitted by law, AroundEx will not be liable for any indirect, incidental, consequential, or special damages arising from use of the Service.
- 2. Maximum Liability: If any liability is found, AroundEx’s total liability will be limited to the amount of fees paid to AroundEx (if any) in the previous six (6) months prior to the claim.
11. Termination
- 1. Termination by User: You may stop using the platform at any time.
- 2. Termination by AroundEx: We reserve the right to suspend or terminate access to the Service at any time, with or without notice, if a User violates these Terms or behaves in a way that could harm the platform or other Users.
12. Governing Law & Dispute Resolution
- 1. Governing Law: These Terms are governed by the laws of the jurisdiction in which AroundEx is registered (e.g., [State/Country]).
- 2. Dispute Resolution: Any disputes should first be attempted to be resolved amicably. If not resolved, disputes may be submitted to mediation or binding arbitration, depending on local legal requirements.
13. Changes to Terms
AroundEx may update or modify these Terms from time to time. Users will be notified of material changes, and continued use of the platform after changes become effective indicates acceptance of the new Terms.
