Terms and Conditions

Welcome to AroundEx (“the Platform”). AroundEx provides an online marketplace (the “Service”) where:
- Travelers can offer space in their personal luggage to carry items for Senders on their trips to earn additional income.
- Senders can request Travelers to deliver items on their behalf to a specified location.

By using AroundEx, you (“User,” “you,” or “your”) agree to the following Terms and Conditions (“Terms”). If you do not agree, do not use the Service.

1. User Eligibility

• You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account.
• By registering, you represent that you have the legal capacity to enter into these Terms.
• AroundEx reserves the right to suspend or terminate any account if there is a violation of these Terms or any applicable laws.

2. Scope of Services

• Marketplace Only: AroundEx is a neutral platform that facilitates connections between Senders and Travelers. We are not a shipping company, air courier, customs broker, or freight forwarder.
• No Endorsement: AroundEx does not endorse, guarantee, or take responsibility for Users’ compliance with laws, including customs regulations, prohibited items, or airline baggage rules.

3. User Responsibilities

3.1 Sender Responsibilities

• Accurate Item Descriptions: You must accurately describe any item(s) you wish the Traveler to deliver, including weight, dimensions, and contents.
• Legal Compliance: You are solely responsible for ensuring the items are legal in both the origin and destination countries, including import/export compliance.
• Packaging & Documentation: Items must be properly packaged, and you must provide necessary documentation (customs forms, permits, etc.).
• No Dangerous or Prohibited Goods: It is strictly forbidden to send items that are illegal, dangerous, hazardous, or otherwise restricted under any laws.
• Airline/X-Ray Checks: The Sender agrees that all items must go through normal airline security (like X-Ray). AroundEx bears no responsibility for items seized or destroyed by authorities.
• No Liability on AroundEx: AroundEx cannot be held responsible for any item seized or destroyed by authorities. Legal consequences rest solely with the Sender.

3.2 Traveler Responsibilities

• Accurate Trip Information: Provide correct departure, arrival, flight, or transportation details, and communicate any changes to the Sender.
• Check Local Laws: You are responsible for ensuring that carrying items for someone else is permitted under the laws of all relevant countries.
• Airline Baggage Compliance: Comply with airline baggage rules (size, weight, prohibited items, etc.).
• Inspection Rights: You have the right to inspect items before accepting them. If items appear illegal, dangerous, or different from the agreed description, you must refuse.
• No Liability on AroundEx: AroundEx is not responsible for penalties or legal issues you face if you carry illegal or restricted items. You accept full liability for what you transport.

4. Payment Terms

• Negotiated Price: Senders and Travelers negotiate the fee. AroundEx may suggest rates but does not set or control pricing.
• Payment Processing: Payment methods and timelines are agreed upon between Sender and Traveler. AroundEx may facilitate payments, with possible transaction fees.
• Non-Refundable Fees: Any platform fees may be non-refundable unless otherwise stated.

5. Risk Acknowledgment & Disclaimer

• User-to-User Transactions: Deals facilitated by AroundEx are strictly between the Sender and the Traveler. AroundEx is not a party to these agreements.
• No Guarantee: AroundEx does not guarantee successful delivery or the item’s condition, nor does it guarantee that either party will fulfill obligations.
• Release of Liability: Users agree to release AroundEx from any claims or disputes arising from the Service. AroundEx bears no responsibility for damages, losses, or legal repercussions.

6. Prohibited Activities

• No unlawful use, including transport of illicit substances, weapons, counterfeit goods, etc.
• No fraud or misrepresentation, including providing false item information or defrauding other Users.
• No violation of airline, customs, or postal regulations.
• No attempts to disrupt or harm the platform (hacking, spamming, misuse of data).

7. Intellectual Property

• AroundEx logos, branding, and content are our property.
• You may not use them without written permission, except for fair referencing or linking to the platform.

8. Indemnification

Users agree to indemnify and hold AroundEx harmless from any claims, liabilities, damages, or legal fees arising out of:
- User content or items provided by Sender
- User actions transporting goods or using the platform
- Violations of these Terms or any applicable laws

9. Limitation of Liability

• AroundEx is not liable for indirect, incidental, or special damages resulting from use of the Service.
• If any liability is found, AroundEx’s total liability is limited to the platform fees paid (if any) in the last six (6) months.

10. Termination

• You may stop using the platform at any time.
• AroundEx may suspend or terminate access if you violate these Terms or engage in harmful conduct.

11. Governing Law & Dispute Resolution

• These Terms are governed by the laws of the jurisdiction where AroundEx is registered.
• Any disputes not resolved amicably may be submitted to mediation or arbitration, per local requirements.

12. Changes to Terms

AroundEx may modify these Terms from time to time. Continued use of the platform after updates take effect constitutes acceptance of the new Terms.

13. Disclaimer

• No Legal or Customs Advice: AroundEx does not provide legal, customs, or tax advice. Consult qualified professionals for such matters.
• No Warranty: The Service is provided “as is” and “as available,” without any warranty of any kind.
